Terms of Submission

Welcome to Filmatic! These Terms of Submission outline the process and conditions for submitting films to our platform. By submitting a film to Filmatic, you agree to comply with and be bound by these terms. Please read them carefully.

1. Eligibility

  • Minimum Age: You must be at least 18 years old to submit a film. By submitting, you represent and warrant that you meet this age requirement.
  • Ownership: You must own the rights to the film you are submitting or have obtained all necessary permissions from the rights holders. This includes, but is not limited to, music, images, scripts, and performances contained within the film.

2. Submission Process

  • Account Creation: To submit a film, you must create a Filmatic account, which allows you to manage your submissions, profiles, and other related activities on the platform.
  • Submission Guidelines: All submissions must comply with our content guidelines, including format requirements, resolution standards, and content restrictions. Failure to comply may result in the rejection of your submission.
  • Review Process: Once submitted, your film will be reviewed by our team. We reserve the right to accept or reject any submission based on our criteria, which include but are not limited to content quality, relevance, and adherence to our guidelines.

3. Rights and Permissions

  • Ownership and Intellectual Property: You retain all rights, title, and interest in and to your film and any other content you submit to Filmatic. Submitting content to our platform does not transfer ownership of your intellectual property to Filmatic or any third party.
  • License Grant: By submitting a film to Filmatic, you grant us a worldwide, non-exclusive, royalty-free license to distribute, stream, promote, and otherwise use the film on our platform. This license includes the right to modify, adapt, and create derivative works for promotional purposes.
  • Content Use: Filmatic may use your film, or excerpts from it, in promotional materials, including social media, advertisements, and other marketing channels. You agree that Filmatic has the right to use your name, likeness, and biographical information in connection with such use.
  • Third-Party Rights: You are responsible for ensuring that your film does not infringe on the intellectual property rights or other rights of third parties. You agree to indemnify Filmatic for any claims arising from the use of your film on our platform.

4. Compensation

  • Current Status: By submitting your film to Filmatic, you agree that your film will be hosted and available for streaming on our platform without any immediate compensation. At present, no royalties or payments will be made for films streamed on the platform.
  • Future Royalty Payments: Filmatic plans to implement a royalty payout system in the coming months. Once this system is in place, you will be eligible to receive compensation at a rate of $0.005 per minute streamed of your film. Filmatic will notify you when this royalty system becomes active and provide details on how payments will be calculated and distributed.
  • Agreement to Terms: By submitting your film, you acknowledge and agree that you are allowing Filmatic to stream your content for free until the royalty payout system is implemented. You further agree that any future royalty payments will be subject to the terms and conditions in effect at the time the payout system is launched.
  • No Guarantee: Submission of a film does not guarantee acceptance onto the platform or future payment. Filmatic reserves the right to modify, delay, or cancel the planned royalty payout system at its sole discretion if complications arise.

5. Content Restrictions

  • Prohibited Content: Submissions must not contain any material that is illegal, offensive, defamatory, or otherwise violates our content policies. This includes but is not limited to hate speech, explicit content, or any material that may harm our users or the reputation of our platform.
  • Compliance with Laws: All films must comply with applicable local, national, and international laws. This includes laws relating to copyright, trademark, privacy, and other relevant areas.

6. Confidentiality

  • Review Process Confidentiality: The details of your submission, including the content of the film and any related materials, will be kept confidential during the review process. Filmatic will not disclose these details to third parties without your consent, except as required by law.
  • Public Availability: Once your film is accepted and published on Filmatic, it will be publicly accessible to all users of the platform. You retain the right to request removal of your film at any time, subject to any obligations under a separate agreement.

7. Liability and Indemnification

  • Liability Disclaimer: Filmatic is not liable for any loss, damage, or harm arising from the submission or distribution of your film. You agree that submitting your film is at your own risk.
  • Indemnification: You agree to indemnify and hold harmless Filmatic, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your submission or the use of your film on our platform.

8. Modifications to Terms

  • Right to Modify: Filmatic reserves the right to modify these Terms of Submission at any time. We will notify you of any changes by posting the updated terms on our website or by email. Your continued submission or use of our platform after the changes have been posted constitutes your acceptance of the new terms.

9. Termination of Submission

  • By You: You may withdraw your submission at any time prior to its acceptance by Filmatic. Once a film is accepted and published, removal requests must be submitted in writing and will be subject to the terms of any agreement governing the film's distribution on our platform.
  • By Us: Filmatic reserves the right to reject or remove any submission at its discretion, including for violations of these Terms of Submission or our content policies.

10. Governing Law

These Terms of Submission are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Australia.
